Terms and Conditions

These terms and conditions ("Terms") apply to all quotations, services and works provided by Best Painting & Waterproofing ("we", "us", "our") and to your use of this website. By accepting a quotation or using this website you agree to these Terms. Please read them together with our Payment Terms and Privacy Policy.

1. Quotations

• Quotations are valid for 30 days from the date of issue unless stated otherwise.
• Quotations are based on the information available and the site conditions visible at the time of inspection.
• Prices include GST unless stated otherwise.
• Work not described in the quotation is excluded and may be charged as a variation.

2. Acceptance

A quotation is accepted when you confirm acceptance in writing (including email) or pay any required deposit. Where the work is residential building work in NSW, a written contract will be provided in accordance with the Home Building Act 1989 (NSW) where required.

3. Variations

Any change to the scope of works, including additional work required due to concealed or unforeseen conditions (for example rotten framing, damaged substrates, asbestos or structural defects), will be documented as a variation and agreed with you before proceeding wherever practical.

4. Site access and preparation

• You must provide safe and clear access to the work area, water and power.
• Furniture, valuables and fragile items should be removed from the work area prior to commencement.
• Where other trades are involved, we rely on them to complete their work to allow ours to proceed.

5. Weather and curing times

Waterproofing membranes and coatings require suitable weather and curing conditions. We may reschedule work for rain, humidity or temperature to protect the quality of the result. Timeframes are estimates only.

6. Warranties

Our workmanship warranty is set out in writing on your quotation or invoice. Product warranties are provided by the relevant manufacturers. Nothing in these Terms excludes your rights under the Australian Consumer Law or the statutory warranties that apply to residential building work under the Home Building Act 1989 (NSW).

Warranties do not cover damage caused by structural movement beyond normal tolerances, misuse, lack of maintenance (such as blocked outlets), alterations by others or the failure of products or work not supplied by us.

7. Ownership and payment

Materials remain our property until paid for in full. Payment requirements are set out in our Payment Terms.

8. Liability

To the extent permitted by law, our liability is limited to re-supplying the services or paying the cost of having them supplied again. We are not liable for indirect or consequential loss. This does not limit any rights you have under the Australian Consumer Law.

9. Website use

10. Disputes

If you have a concern, please contact us first so we can try to resolve it quickly. Residential building disputes in NSW may also be referred to NSW Fair Trading.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia.
